EVAN D. SMILEY is a partner of Smiley Wang-Ekvall, LLP. He concentrates his practice on bankruptcy/insolvency matters and complex business litigation in federal and state courts.
Mr. Smiley is a former President of the Orange County Bankruptcy Forum and a former Director of the California Bankruptcy Forum. He is certified as a specialist in Business Bankruptcy Law by the American Bankruptcy Institute. In the years 2005 – 2015, Mr. Smiley was selected by the publishers of Los Angeles Magazine as a Super Lawyer, representing the top 5% of the practicing attorneys in Southern California. He is AV‑Rated by Martindale‑Hubbell, the highest rating for ethical standards and legal ability, and has been named as one of the Top Bankruptcy Lawyers in OC Metro Magazine and Orange Coast Magazine. Mr. Smiley is also included in the 2010 ‑ 2016 editions of The Best Lawyers in America in the specialty of Bankruptcy and Creditor‑Debtor Rights Law which also appears in U.S. News & World Reports. He is a frequent speaker on insolvency and bankruptcy issues and co‑authored Bankruptcy for Businesses, published in April, 2007 by Entrepreneur Media, Inc., and distributed by McGraw‑Hill.
He received his undergraduate degree in business administration (finance) in 1989 from California State University at Northridge and his law degree in 1992 from University of the Pacific, McGeorge School of Law, where he was a Law Review writer and editor. He also served on the Alumni Board of Directors for Pacific McGeorge School of Law and served as chair for the Orange County Alumni Chapter. He served a judicial clerkship to the Honorable John E. Ryan, United States Bankruptcy Judge for the Central District of California, from September 1992 to September 1993, and an externship to the Honorable James N. Barr, United States Bankruptcy Judge for the Central District of California, in 1991. He is a Fellow of the Orange County Bar Foundation.
Mr. Smiley has served as lead counsel in some of the largest chapter 11 cases in the United States, and frequently represents companies in workouts, assignments, and receiverships. He also represents borrowers, lenders, companies, and professional athletes in state and federal court litigation.
